New Condo Safety Laws Affecting Palm Beach Real Estate
Earlier this summer, Governor Ron DeSantis signed House Bill 913 and House Bill 393 into law, adjusting the state's condo safety requirements that followed the 2021 collapse of Champlain Towers South. The legislation extends the deadline for structural integrity reserve studies to the end of this year, allows some associations to pause or reduce reserve contributions under specific conditions, and raises the minimum cost threshold for major reserve projects. It also strengthens disclosure requirements around conflicts of interest in milestone inspections.
More recently, a new state report analyzed milestone inspection data collected in 2024 and 2025. The findings show that thousands of buildings statewide have completed their required inspections, with the highest concentration of unsafe or uninhabitable findings located in South Florida. The report also confirmed that repair costs varied enormously, from under $1,000 to as much as $30 million, with most required repairs tied to concrete, electrical, and structural issues.
Over the past several months, we have seen firsthand how much buyers now weigh a building's inspection and assessment history before making an offer. Properties where special assessments have already been paid in full are increasingly viewed as a meaningful advantage, not simply a nice-to-have detail. Buildings that have completed comprehensive restoration projects, from concrete restoration to structural upgrades, are positioned more competitively than buildings still facing that work ahead.
Sellers who can speak clearly to reserve funding, inspection status, and planned capital improvements are seeing stronger results.
Buyers, in turn, are treating a building's financial and structural health as a core part of their due diligence.
